InVue warrants that if, within one (1) year of purchase of a product (“Warranty Period”), should there be a defect in material or workmanship, and the product has received normal use and care, the product will be repaired or replaced free of charge, as determined by InVue in its sole discretion. All claims of defects shall be made in writing no later than ten (10) business days after discovery thereof.
This warranty no way applies to (i) abuse, neglect, misuse, tampering, accident, or use not in accordance with InVue’s applicable product specifications or instructions, (ii) consumable parts, such as batteries and adhesives that diminish over time, (iii) cosmetic damage, (iv) modifications, customizations, development, or requested changes to products, or (v) defects caused by a third-party component, product, or software that is not pre-approved by InVue.
InVue does not accept returns of non-defective products unless otherwise expressly agreed to in writing by InVue. In the event InVue agrees to accept a return of non-defective products in its sole discretion, InVue may charge Purchaser a reasonable restocking fee.
Customer shall be responsible for removing and reinstalling all the parts or components of the products returned to InVue for repair under the warranty.
Any products provided by InVue as part of an evaluation, demo, or proof of concept are not covered under any warranty.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, SUPPLIER DISCLAIMS ANY AND ALL WARRANTIES WITH RESPECT TO THE PRODUCTS AND SERVICES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTIES ARISING AS A RESULT OF SUPPLIER USAGE IN THE TRADE OR BY COURSE OF DEALING. THE PRODUCT IS NOT A SALE OF CONSUMER GOODS AND IS FOR COMMERCIAL OR BUSINESS USE ONLY.
INVUE’S ONLY OBLIGATION SHALL BE TO REPAIR OR REPLACE SUCH PRODUCTS PROVED TO BE DEFECTIVE. INVUE SHALL NOT IN ANY WAY BE LIABLE EITHER IN TORT OR IN CONTRACT FOR ANY LOSS OR DAMAGE, DIRECT OR INCIDENTAL, OR CONSEQUENTIAL, ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCTS. IN NO EVENT SHALL INVUE’S LIABILITY EXCEED THE PURCHASE PRICE OF ANY PRODUCT.
